Business strategy in the pharmaceutical industry is subject to numerous constraints, not least of which are the legal and scientific exigencies associated with patenting new drugs (and "evergreening" existing drugs). The proposed panel will address these constraints, and explore how concerns relating to patents influence near-and long-term business strategies. What is the effect of proposed Hatch-Waxman legislation on continued development and marketing of biologics? What is the economic impact of generic manufacturers' "launch at risk" strategies? How are patent litigation settlements affecting long-term business decisions in the industry? How does the declining number of patents affect the long-term viability of generic manufacturers? Legal and business experts from across the pharmaceutical industry will discuss these issues.
